1. What NIL Kit Is

NIL Kit is a content and marketing tool that helps athletes generate personal brand materials, including bios, content strategy suggestions, sponsor pitch materials, and related assets, using AI-generated content based on information you provide.

NIL Kit is not an agent, agency, or representative. We do not negotiate, broker, or take any commission on Name, Image, and Likeness (NIL) deals or sponsorships. Any partnerships, deals, or compensation you pursue using materials generated by NIL Kit are entered into independently by you. You are solely responsible for reporting any NIL deals as required by your school, conference, state law, or the NCAA (or equivalent governing body), and for ensuring any partnership complies with applicable rules.

2. Accounts

You must provide accurate information when creating an account. You're responsible for keeping your login credentials secure and for any activity under your account.

3. Minors & Parental Consent

NIL Kit is built for student athletes, including high school athletes who may be under 18. If you're under 18, you confirm that a parent or guardian has given you permission to create an account and use the Service, and that any NIL sponsorship or partnership you pursue using materials generated here complies with your state's NIL rules for minors (many states require parental co-signature or involvement on NIL agreements entered into by a minor).

We do not knowingly allow children under 13 to create an account. See our Privacy Policy for how we handle this.

The sponsor marketplace (where businesses can browse and connect with athletes) is currently limited to college-level accounts.

4. Subscription & Billing

• NIL Kit offers a free tier and a paid subscription tier (“Pro”).
• Pro subscriptions are billed monthly through Stripe, our payment processor. We do not store your full payment card details.
• You can cancel your subscription at any time through the billing portal in your account dashboard. Cancellation stops future billing; it does not retroactively refund the current billing period unless stated otherwise in our Refund Policy.
• We may change subscription pricing in the future. If we do, we'll provide notice before the change takes effect for existing subscribers.

5. AI-Generated Content

Content generated through NIL Kit (bios, pitch materials, content calendars, etc.) is created using AI based on the information you provide. While we aim for high-quality, relevant output:

• We do not guarantee the accuracy, originality, or effectiveness of any generated content.
• You are responsible for reviewing, editing, and fact-checking any content before using it publicly or sending it to a third party (such as a prospective sponsor).
• Generated content is provided as a starting point and creative resource, not professional legal, financial, or marketing advice.

6. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to abuse, overload, or interfere with the Service (including circumventing usage limits)
• Impersonate another person or provide false information about yourself
• Use generated content to mislead sponsors, fans, or the public

We reserve the right to suspend or terminate accounts that violate these terms.

7. Intellectual Property

You own the content you generate about yourself using NIL Kit. We retain ownership of the Service itself, including its design, code, and underlying technology.

8. Disclaimers & Limitation of Liability

The Service is provided “as is,” without warranties of any kind. To the fullest extent permitted by law, NIL Kit and its owner are not liable for any indirect, incidental, or consequential damages arising from your use of the Service, including but not limited to lost sponsorship opportunities, inaccurate content, or NIL compliance issues.

Nothing in these terms limits liability where it cannot legally be limited.

9. Changes to These Terms

We may update these terms from time to time. Continued use of the Service after changes take effect constitutes acceptance of the new terms.
